Legislation on specific anti-avoidance rules (SAAR) as economic substance requirements, controlled foreign companies, place of effective management and substance over form doctrine. Implications of the base erosion and profit shifting (BEPS) under the OECD action plan for Thai taxation. Not yet codified general anti-avoidance resp. anti-abuse rules (GAAR) or fraus legis doctrine and how they are currently already utilized by Thailand’s Revenue Department to deny tax benefits if a transaction is non-genuine.
